Telecom Subscriber Base Rise Marginally to 1,170.75 Million in Jan 2023: TRAI

Telecom Subscriber Base Rise Marginally to 1,170.75 Million in Jan 2023: TRAI

The telecom subscriber base in the country grew marginally to 1,170.75 million in January, driven by net customer gain in the fixed line segment, according to a sector regulator TRAI report released on Friday.

The net gain in the wireline segment was 0.28 million customers while mobile telephony recorded a net gain of 0.09 million subscribers.

Even though Reliance Jio and Bharti Airtel jointly added 0.29 million new customers, the gain was offset by BSNL and Vodafone Idea (VIL) losing 0.28 million customers.

"The number of telephone subscribers in India increased from 1,170.38 million at the end of December 2022 to 1,170.75 million at the end of January 2023, thereby showing a monthly growth rate of 0.03 percent," the Telecom Regulatory Authority of India said in the subscriber report for the month of January 2023.

The wireline or fixed line connections in the country increased to 27.73 million in January from 27.45 million in December.

The growth in the wireline segment was driven by Reliance Jio, Bharti Airtel and Quadrant, which added 0.21 million, 0.11 million and 5,949 customers, respectively.

State-owned MTNL was the biggest loser in the segment as it lost 29,857 customers. It was followed by BSNL, which lost 19,781 wireline customers, Tata Teleservices 9,444, VIL 3,727 and Reliance Communications 275 customers.

In the mobile telephony or wireless segment, Reliance Jio and Bharti Airtel added 1.65 million and 1.28 million customers, respectively. BSNL, VIL and MTNL mitigated the growth in the segment by losing 1.48 million, 1.35 million and 2,960 mobile subscribers, respectively.

The broadband subscriber base in the country grew to 839.18 million in January from 832.2 million in December.

"Top five service providers constituted 98.39 per cent market share of the total broadband subscribers at the end of January-23. These service providers were Reliance Jio Infocomm (434.02 million), Bharti Airtel (237.40 million), Vodafone Idea (125.03 million), BSNL (27.05 million) and Atria Convergence (2.14 million)," TRAI said.

Ashok Gehlot's "Cops Should Ask Amit Shah" Retort To "Frame Modi" Comment

Ashok Gehlot's "Cops Should Ask Amit Shah" Retort To "Frame Modi" Comment

Rajasthan Chief Minister and Congress leader Ashok Gehlot has dared Home Minister Amit Shah to name the officers of a central agency who the BJP leader alleged had put pressure on him to frame his party colleague and the then Gujarat Chief Minister Narendra Modi in a fake encounter case.

Mr Gehlot said if the Delhi Police can ask Congress leader Rahul Gandhi to give details of women in Jammu and Kashmir who have alleged sexual harassment, the same cops can surely ask Mr Shah to give the names of the officers who wanted him to frame Narendra Modi before he became Prime Minister in 2014.

During the Bharat Jodo Yatra, Mr Gandhi had alleged  "women were still being sexually assaulted" in the Union Territory. After the yatra ended and 45 days later, a Delhi Police team knocked on Mr Gandhi's doors thrice in five days, which the Congress termed unprecedented harassment. The Congress alleged the cops won't do any such thing if BJP leaders gave controversial comments at public events.

"What did the women tell Rahul Gandhi in Kashmir? That they have been abused, harassed. And what happened after that - Delhi police arrived at Rahul Gandhi's door. Rahul said he will respond to the cops' notice, but the police again arrived at his home," Mr Gehlot told NDTV.

"So will the Delhi police also send a notice to Amit Shah for saying that the CBI (Central Bureau of Investigation) was putting pressure on him to frame Prime Minister Narendra Modi in an alleged fake encounter case in Gujarat when he was being questioned by the probe agency during the Congress-led UPA government. That's why I am asking, will the Delhi Police question Amit Shah like they questioned Rahul Gandhi? I think they should," Mr Gehlot said.

Mr Shah yesterday at the 'News 18 Rising India' programme alleged the CBI had put pressure on him to frame PM Modi in a fake encounter case in Gujarat back when the United Progressive Alliance (UPA) was in power. The Home Minister was replying to a question on the opposition's allegations that central agencies have been sent to harass them frequently with false cases.

"The CBI put pressure on me to frame Modi ji (when he was Gujarat Chief Minister) in a fake encounter case during the Congress government," Mr Shah said.

The BJP has also often cited alleged misuse of central agencies when the Congress was in power.

US Chipmaker Micron's Products to Be Examined in China for Cybersecurity Risks

US Chipmaker Micron's Products to Be Examined in China for Cybersecurity Risks

China's cyberspace regulator will conduct a cybersecurity review of products sold in the country by US memory chip manufacturer Micron Technology, the regulator said on Friday.

The move, which comes amid a spat over chip technology between Washington and Beijing, is aimed at protecting the security of the supply chain for critical information infrastructure, prevent hidden risks and safeguard national security, the Cyberspace Administration of China said in a brief statement.

It gave no other details, including which Micron products it was reviewing.

The United States has imposed a series of export controls on chipmaking technology to China for fear it could be used to produce chips for applications such as artificial intelligence which could be used by China's military, and blacklisted a number of China's largest chip firms, including Micron rival Yangtze Memory Technologies Co Ltd.

Micron, one of the world's largest memory chip makers, did not respond immediately to a request for comment. The company's shares fell 3 percent on Friday.

"Punitive actions against Micron could suggest a broader shift in Chinese policy with other US vendors with large Chinese exposure now potentially at risk of similar actions," Wedbush Securities analyst Matthew Bryson said.

On Friday, Japan announced it would align its technology trade controls with a US push to curb China's ability to make advanced chips. The Netherlands, which makes advanced lithography equipment critical for the manufacture of advanced chips, made a similar announcement earlier this month.

Weak consumer demand has roiled the memory chip market, which is dominated by South Korea's Samsung Electronics.

Micron derives around 10 percent of its revenue from China, but it was not clear if the review would affect the company's sales to non-Chinese customers in the country.

The larger chunk of the company's products flowing into China are being purchased by non-Chinese firms for use in products manufactured in the country, according to analysts.

Micron has offices in Shanghai and Shenzhen, as well as a chip packaging facility in the city of Xian. In early 2022, the company announced it would shut its DRAM design operations in Shanghai.

Howrah Violence To Be Probed By Criminal Investigation Department

Howrah Violence To Be Probed By Criminal Investigation Department

Following violence in Howrah during Ram Navami celebrations, West Bengal government on Friday handed over the probe to Criminal Investigation Department (CID).

A special team led by Inspector General of Police, CID Sunil Choudhury has initiated the investigation.

The situation turned violent in Shibpur area of Howrah on Friday. Fresh violence broke out here, on Friday a day after arson on Ram Navami.

Several vehicles were set on fire earlier on Thursday after two groups clashed in Howrah amid Ram Navami celebrations. During the procession, the rioters vandalized public and private properties and set vehicles on fire.

Meanwhile, Union Home Minister Amit Shah spoke to West Bengal Governor CV Ananda Bose and took stock of the situation in Howrah where violence broke out.

Amit Shah also called West Bengal BJP president Sukanta Majumdar and enquired about the law and order situation in the state.

West Bengal BJP chief on Friday wrote to Union Home Minister Amit Shah seeking National Investigation Agency (NIA) probe into violence in Howrah during Ram Navami celebrations.

Following the violence in West Bengal's Howrah during Ram Navami celebrations, Leader of Opposition in the State Legislative Assembly and BJP leader Suvendu Adhikari on Friday filed a PIL in Calcutta High Court seeking a NIA probe into the matter and immediate deployment of Central Forces in the violence-affected areas.

The Acting Justice of Calcutta High Court granted leave to file the PIL and directed the same to appear at top of the list on Monday, April 3.

Speaking to ANI, Suvendu Adhikari said, "Police (Home) Minister (Mamata Banerjee) is useless. Her resignation is the only solution. I sent a mail to the Union Home Minister and Governor yesterday. Today I approached the High Court. Governor is going to visit the spot. The Court should step forward. All this should stop. Section 144 (CrPC) has been imposed here."

West Bengal Police on Thursday conducted a flag march in Howrah where violence broke out during a Ram Navami procession.

TerraUSD Founder Do Kwon Indicted in US Following Montenegro Arrest

TerraUSD Founder Do Kwon Indicted in US Following Montenegro Arrest

Do Kwon, the cryptocurrency entrepreneur behind two digital currencies that lost an estimated $40 billion (nearly Rs. 3,28,500 crore) or more last year, has been charged with fraud by US prosecutors.

An eight-count indictment against Kwon was made public in the US District Court in Manhattan, several hours after news of his arrest earlier Thursday in Montenegro.

Lawyers for Kwon in the United States did not immediately respond to requests for comment after business hours.

Thursday's indictment charges Kwon, a South Korean national who co-founded Terraform Labs and developed the TerraUSD and Luna currencies, with two counts each of securities fraud, wire fraud, commodities fraud and conspiracy.

The criminal case follows related US Securities and Exchange Commission civil charges against Kwon and Terraform last month.

Kwon had been a fugitive for several months, and South Korean authorities issued an arrest warrant for him last September.

South Korean police said on Friday that the identity of the suspect arrested in Montenegro had been confirmed as Kwon after his fingerprints matched the information held by the country's National Police Agency (KNPA).

"This has been shared with the Seoul Southern District Prosecutors' Office and Interpol in Montenegro," one official at the KNPA said.

Prosecutors will work with other institutions to carry out a swift repatriation, a spokesperson for the country's prosecution service said.

Montenegro's interior ministry said police detained a person thought to be Kwon and a second suspect, who were trying to board a flight to Dubai at Podgorica airport.

Police found forged passports of Costa Rica and Belgium during the encounter, the ministry said.

"The person is suspected of being one of the most wanted fugitives, South Korean national Do Kwon, a co-founder and CEO of the Singapore-based Terraform Labs," Interior Minister Filip Adzic wrote on Twitter.

"The former cryptocurrency king who is behind losses of over $40 billion, has been apprehended at the Podgorica airport with forged documents," Adzic added.

TerraUSD was a so-called "stablecoin" designed to maintain a constant $1 price, while Luna's value fluctuated.

But authorities have said TerraUSD and Luna were paired, such that a decline in one could take down the other.

They also said Kwon misrepresented the stability of TerraUSD, once among the top 10 cryptocurrencies by market value.

Both currencies crashed last May, with TerraUSD's price sinking to less than one penny.

In its civil case, the SEC accused Kwon and Terraform of "orchestrating a multi-billion dollar crypto asset securities fraud.

"We also allege that they committed fraud by repeating false and misleading statements to build trust before causing devastating losses for investors," SEC Chair Gary Gensler said in a statement at the time.

History Of Freedom Struggle Was Confined To 1 Family Till Modi Became PM: Amit Shah

History Of Freedom Struggle Was Confined To 1 Family Till Modi Became PM: Amit Shah

Union Home Minister Amit Shah on Thursday said the history of India's freedom struggle was confined to one family but Prime Minister Narendra Modi put an end to it by "immortalising" Sardar Vallabhbhai Patel.

The Ram Temple issue was stuck "since the time of Babur", but just after the Supreme Court order, the prime minister did Bhumi Pujan in Ayodhya. Mr Shah said Lord Ram will be in his grand temple by next year's Ram Navami.

Soon after landing at the Bhalla College helipad here, Mr Shah was faced with denunciatory slogans by Congress workers at Parashuram Chowk against over the disqualification of Rahul Gandhi as MP. Some of them showed black flags to the home minister and were detained by police.

Addressing the 2nd Sanyas Diksha Mahotsav at Yoga guru Ramdev's Patanjali Yogpeeth, Mr Shah said the prime minister immortalised Sardar Vallabhbhai Patel by erecting the Statue of Unity at Kevadia in Gujarat in his memory.

"India's freedom struggle was confined to one family, but prime minister Modi put an end to it by immortalising Patel with the Statue of Unity," Mr Shah said.

He said PM Modi has revived the symbols of Hinduism, reconstructed centres of the Hindu faith like the Kashi-Vishwanath and Somnath temples and retrieved idols from across the world, which were stolen from India during the period of slavery.

The Union minister highlighted the reconstruction projects undertaken in Kedarnath and Badrinath under Modi's guidance to further substantiate his point.

Amit Shah also credited Modi for getting Yoga the recognition it deserved on an international platform by standing up for it at the United Nations.

He said Ramdev was a yoga therapist, a swadeshi pioneer competing with International companies, a seer who had waged a war against black money and an educationist who is fully committed to "Indianise" education.

Congratulating 100 new 'sanyasis', including men and women, who were conferred with "sanyas diksha" by Patanjali on Thursday at a ceremony on the banks of the Ganga held earlier in the day, Mr Shah said he is happy to see that ancient Indian knowledge will derive new energy from the "army" of young sanyasis prepared by Patanjali.

He said Ramdev's individual contribution to yoga, Ayurveda and swadeshi was more than an institution could do for them.

Amit Shah praised Ramdev's close aide Acharya Balkrishna for his extensive research work in the field of Ayurveda, saying he had published more than 500 research papers on Ayurveda.

Home Minister Amit Shah performed a havan at Patanjali Yogpeeth before beginning his address.

Earlier in the day, Shah hailed the central government's New Education Policy for its emphasis on learning in the mother tongue and universal education based on the teachings of Indian visionaries such as Mahatma Gandhi and Dayanand Saraswati.

Addressing the 113th convocation of the Gurukula Kangri here, Shah credited the university (deemed to be) for the revival of vedic education in India and combining it with modern education.

Mr Shah paid tributes to the university's founder Swami Shraddhanand saying he set India's education system free from the stranglehold of the British and revived the country's vedic education system, all the while emphasising culture and modern education.

The home minister also addressed a programme at Rishikul to mark the total computerisation of 670 cooperative centres.

"It has been done in just 17 months. I heartily congratulate Chief Minister Pushkar Singh Dhami and Health and Cooperative Minister Dhan Singh Rawat on this achievement," he said.

Mr Shah gave the credit for this achievement to the separate cooperative ministry set up under the leadership of the prime minister.

Computerisation of cooperative platforms will lead to total transparency and greater fiscal discipline, Amit Shah, who is also the Union cooperative minister, said.

Turkey Approves Finland's Bid To Join NATO

Turkey Approves Finland's Bid To Join NATO

Turkey on Thursday became the final NATO nation to ratify Finland's membership of the US-led defence alliance in the wake of Russia's invasion of Ukraine.

Lawmakers unanimously backed the Nordic country's accession two weeks after President Recep Tayyip Erdogan publicly blessed the bid.

"This evening, we are keeping the promises we made to Finland," ruling party lawmaker Akif Cagatay Kilic said moments before the vote.

Turkey's approval leaves Finland -- which has a 1,300-kilometre (800-mile) border with Russia -- with only a few technical steps before it becomes the 31st member of the world's most powerful military bloc.

Officials expect the process to be completed as early as next week.

Finland and its neighbour Sweden ended decades of military non-alignment and decided to join NATO last May.

Their applications were accepted at a June alliance summit that was designed to show the Western world's desire to stand up to Russia in the face of Europe's most grave conflict since World War II.

But the bids still needed to be ratified by all the members' parliaments -- a process that stalled with Turkey and Hungary.

- 'Ample grievances' -

Erdogan put up stiff resistance to Sweden's candidacy because of a series of long-standing disputes.

He first signalled his more supportive stance on Finland's membership in January -- a position that forced the Nordic neighbours to bow to the diplomatic pressure and break up their bids so that both applications were not delayed.

The Hungarian parliament ratified Finland's NATO membership on Monday. It was expected to approve Sweden's accession during the current session ending June 15.

But a spokesman for Hungarian Prime Minister Viktor Orban on Wednesday called on Sweden to "clear the air" and address "an ample amount of grievances" for the vote to go ahead.

Sweden has upset Orban -- one of Europe's closest allies of Russian President Vladimir Putin -- by expressing alarm over the rule of law in Hungary.

It has also angered Turkey by refusing to extradite dozens of suspects that Erdogan links to a failed 2016 coup attempt and a decades-long Kurdish fight for an independent state.

Stockholm still hopes to join the alliance in time for a July summit in Vilnius.

Most analysts believe that Turkey will only vote on Sweden's candidacy after the country's May general election.

- 'Legitimate target' -

NATO was created as a counterweight to the Soviet Union at the onset of the Cold War era that began immediately after the Allies defeated Nazi Germany.

The bloc has gone through waves of expansion that brought it ever closer to Russia's borders.

NATO's reach into east and south European countries that were once under Moscow's effective control infuriated the Kremlin and created growing strains in its relations with Washington.

Putin cited the threat of NATO expanding into Ukraine as one of his main reasons for launching the war 13 months ago.

But the conflict has had the opposite geopolitical effect from the one envisioned by Putin.

Ukraine is now receiving tanks and other heavy weapons from NATO members that it hopes to use in a new counter-offensive planned for the coming weeks or months.

Finland never seriously discussed NATO membership until Putin went to war.

The Kremlin at first appeared to play down the significance of the bloc reaching a new stretch of Russia's northwestern frontier.

But Russia has stepped up its diplomatic rhetoric in recent weeks.

Stockholm this week summoned the Russian ambassador after he said Sweden and Finland would become a "legitimate target" of "retaliatory measures" -- including military ones -- if they join NATO.

Putin last weekend also announced plans to deploy tactical nuclear weapons in neighbouring Belarus.

86-Year-Old British Grandfather Breaks World Weightlifting Record

86-Year-Old British Grandfather Breaks World Weightlifting Record

At the age of 86, going to the gym and performing consistent workouts for six days a week is undoubtedly challenging, but a British grandfather has defied all expectations and set a new world record in weightlifting.

According to a BBC report, "Brian Winslow lifted 75kg (165lb) with his first attempt in the deadlift at the 2023 British Drug Free Powerlifting Association (BDFPA) championships on March 18. The lift was a UK record for someone of Mr. Winslow's age and weight. Mr. Winslow, from Derbyshire, then bettered it with a lift of 77.5kg (171lb) with his very next effort."

The former art teacher first became interested in weightlifting while working as a beach attendant in Paignton, south Devon, in the 1950s.

Brian Winslow has been bodybuilding for more than 60 years and still trains six days a week in his home gym. He has converted the downstairs of his home in New Mills, Derbyshire, into a fully equipped gym, as reported by Wales Online.

"I'm absolutely delighted to have broken the record. It's always great to break a record or two. I was exhausted straight afterward but was fine after a cup of tea and a good meal. I'm only disappointed I couldn't get the third lift. It wasn't too heavy for me; I just got the technique wrong because I was thinking too much about what I was doing. I've lifted 80kg before at home, and nine years ago I lifted 150kg in the gym," Brian Winslow said.

According to the British Drug Free Powerlifting Association (BDFPA), Brian currently owns the British and World Records in the 60 kg class for male contestants between the ages of 85 and 89.

"Sanatan Doesn't Need Any Certificate": RSS Chief Mohan Bhagwat

Rashtriya Swayamsevak Sangh Chief Mohan Bhagwat on Thursday said that the 'Sanatan' dharma doesn't need any "certificate" as it has been proven true to the test of time.

"Today you are taking the resolve to enhance the prestige of the saffron colour by donning it. The one that is 'Sanatan' doesn't need any certificate. In English, they say, "time proven". It has proven to stand true to the test of time," RSS Chief said while addressing an event of 'Sanyas Diksha' in Uttarkhand's Haridwar.

He further said that the Sanatan dharma, which started earlier, exists today and will also be there tomorrow.

"Everything else changes. It started earlier, exists today and will be there tomorrow as well. We will have to explain 'Sanatan' to people through our conduct," Mr Bhagwat said.

Mohan Bhagwat reached Rishigram and performed the Chaturveda Parayan Yagya on the eighth day of the Sannyas festival in Patanjali Sannyas.

Pope Francis Hospitalised In Rome For Respiratory Infection

Pope Francis Hospitalised In Rome For Respiratory Infection

Pope Francis, 86, was admitted to a hospital in Rome on Wednesday with a respiratory infection which will require a stay of a few days, the Vatican said.

"In recent days Pope Francis has complained of some breathing difficulties," said Vatican spokesman Matteo Bruni in a statement.

The pontiff was admitted to Rome's Gemelli hospital for medical checks, which revealed "a respiratory infection... that will require a few days of appropriate hospital medical treatment", Bruni said, adding that a Covid-19 infection had been excluded.

Earlier in the afternoon, the Vatican had said Francis had been admitted "for some previously scheduled checks."

The pope, who this month marked 10 years as head of the Catholic Church, had earlier appeared in good spirits at his weekly audience at the Vatican, smiling as he greeted the faithful from his "popemobile".

However, he was seen grimacing as he was helped getting into the vehicle and Italian media reported he was taken to hospital by ambulance.

"Pope Francis is touched by the many messages received and expresses his gratitude for the closeness and prayer," said Bruni's statement.

A Vatican source told AFP that the pope's appointments for Thursday morning were cancelled.

The Argentine pontiff suffers from chronic knee pain that has forced him to rely on a wheelchair in recent months.

The Gemelli was the same hospital where he underwent an operation on his colon in July 2021 after suffering from a type of diverticulitis, an inflammation of pockets that develop in the lining of the intestine.

He remained in hospital for 10 days. A year later he admitted he was still feeling the effects of six hours spent under anaesthetic during the surgery.

In an interview in January, Francis said the diverticulitis had returned.

- Speculation -

Pope Francis had to cancel or curtail activities several times last year because of the pain in his knee and in a July 2022 interview acknowledged that he needed to slow down.

His health has been the frequent subject of speculation, particularly the question of whether he will follow the example set by his predecessor and retire if he cannot continue.

Benedict XVI, an eminent German theologian, shocked the world in 2013 by becoming the first pope since the Middle Ages to resign.

The two "men in white" co-existed within the walls of the tiny Vatican state for almost a decade, before Benedict died on December 31.

Francis has said he would follow Benedict in stepping down if his health made him unable to do his job.

However, he told an interviewer in February that papal resignations should not become "a normal thing", adding that for the moment it was not on his agenda.

- Still active -

Despite his advancing age and health problems, Francis continues to travel widely.

Huge crowds greeted him on a visit earlier this year to South Sudan and the Democratic Republic of Congo, a testament to his ongoing popularity.

Next month, Pope Francis is due to visit Hungary and meet Prime Minister Viktor Orban.

In the past decade, he has sought to forge an image of a more open, compassionate Church, although has faced internal opposition, particularly from conservatives.

Francis almost died when he was 21 after developing pleurisy -- an inflammation of the tissues that surround the lung -- according to biographer Austen Ivereigh.

He had part of one of his lungs removed in October 1957.

He has also talked about the surgical removal of cysts from the top lobe of his right lung.

He insisted he had made "a complete recovery... and never felt any limitation since then".

Supreme Court Clears 5,000 Crores From SEBI-Sahara Fund To Repay Depositors

The Supreme Court on Wednesday allowed a plea by the Centre seeking allocation of Rs 5,000 crore out of Rs 24,000 crore deposited by the Sahara group with market regulator Sebi to repay dues of the depositors of the Sahara Group of Cooperative Societies.

The direction came on an application filed by the Centre in a PIL by a person named Pinak Pani Mohanty, who sought a direction to pay the amount to the depositors who invested in several chit fund companies and Sahara credit firms.

A bench of justices MR Shah and CT Ravikumar noted that the amount was lying in the "Sahara-SEBI Refund Account" unutilised.

The top court said the prayer sought in the present application seems to be reasonable and which shall be in the larger public interest and interest of the genuine depositors of the Sahara Group of Cooperative Societies.

"Out of the total amount of Rs. 24,979.67 crore lying in the 'Sahara-SEBI Refund Account', Rs. 5000 crore be transferred to the Central Registrar of Cooperative Societies, who, in turn, shall disburse the same against the legitimate dues of the depositors of the Sahara Group of Cooperative Societies, which shall be paid to the genuine depositors in the most transparent manner and on proper identification," the bench said.

The top court also directed that entire disbursement process will be monitored by former top court judge R Subhash Reddy with the assistance of advocate Gaurav Agarwal, who has been appointed as amicus curiae to assist Justice Reddy as well as the Central Registrar of Cooperative Societies.

"The manner and modalities for making the payment is to be worked out by the Central Registrar of Cooperative Societies in consultation with Justice Reddy and Agarwal.

"Rs. 15 lakhs per month be paid to Justice R Subhash Reddy, Former Judge of this Court and Rs. five lakhs per month be paid to Gaurav Agarwal, learned Amicus Curiae towards their honorarium," the bench said.

The top court further directed that the amount be paid to the respective genuine depositors of the Sahara Group of Cooperative Societies not later than nine months from today.

The balance amount thereafter will be again transferred to the Sahara-SEBI refund account, it said.

The Centre had sought money from the SEBI-Sahara Sahara-Sebi escrow account that was formed after the top court in August 2012 directed two Sahara firms -- Sahara India Real Estate Corporation Limited (SIRECL) and Sahara Housing India Corporation Limited (SHICL) -- to refund investors.

Protests At Jamia Millia Islamia In 2019 Was An Unlawful Assembly: Court

Protests At Jamia Millia Islamia In 2019 Was An Unlawful Assembly: Court

The Delhi High Court on Tuesday held that the December 2019 protests organised at Delhi's Jamia Millia Islamia was an unlawful assembly and the mob gathered at the spot with the intention to violate the law.

"The common object of the assembly was to march to the Parliament for registration of their protest against the Government policies of NRC and CAB where a curfew was imposed by the authorities," the Delhi High Court on Tuesday said, adding that making efforts to reach that area and carry out protest there was an "unlawful" object itself.

The Delhi High Court held the view while setting aside the order of the trial court discharging Sharjeel Imam and 10 others.

Justice Swarana Kanta Sharma said that as per the prosecution, section 144 Cr.P.C. was already imposed in the area near Parliament.

"Therefore, making efforts to reach to a curfew imposed area and carry out protest therein was an unlawful object itself," justice Sharma held in the judgement.

The High Court while deciding the revision petition considered the video clips placed on record by the police as significant evidence.

The court said that the same was also brought to the notice of the crowd repeatedly by the concerned police officers by way of repeated announcements which can be clearly seen and heard in video clip number 2.

The high court also noted that the assembly was large and turned violent and pushed the barricades.

The court said, " Even otherwise, the mob was stopped by the police by creating a line of barricades, but the assembly had become so large and was pelting stones, was armed with tyres and dandas, and were shouting, standing on the barricades and violently pushing the same, and if at all they were trying to exercise the fundamental right of freedom of expression, by their unlawful acts of violence as discussed above their assembly had turned unlawful."

"Thus, the very means of achieving the object of reaching the Parliament, where prohibitory orders under section 144 Cr.P.C. was in place, were not lawful also," the court observed.

Thus, as contended on behalf of the state and visible from the video clips, the common unlawful object which was created at the spot was reaching the curfew-bound area and using force and violence against the police officers to achieve the said object, the court further observed.

The bench said that the main aim of their initial protest against the government policy was lost in the violence and in their persistence to break the law to reach a curfew-bound area by use of violence and force against people and objects.

The bench also held that the use of force and violence by the mob is sufficient, at prima facie stage of framing of charge, for constituting the offence of unlawful assembly and rioting.

The bench also noted from the video clips that the police were telling the assembly to protest peacefully.

The court said that nowhere in the video clips, the police officers are seen announcing that the protesters cannot protest, rather they were told to protest peacefully which was their right.

"However, the police were duty bound to stop them from proceeding to a place where section 144 Cr.P.C was imposed and also considering their violent behaviour, the apprehension and the fear that such violent mob while marching to the Parliament could be a threat to law and order situation in Delhi, cannot be found at fault at this stage as the behaviour of the crowd even in the video clips will show that such apprehension was not purely unfounded," the bench held.

On the basis of the video clips, the court held that the mob was trying to stop police from performing their duty of maintaining law and order.

The court said that it is also clear from the video clips that the mob was trying to stop the police officers from discharging their duty of maintaining law and order and were breaking the barricades and crossing over them, on which human chain of police was trying to hold on to so that the mob could not proceed to a curfew bound area.

"Therefore, they were doing their duty and they were stopped from doing so by pelting stones and by pushing the barricades against all of them," the court said.

The court pointed out, "Had the crowd of thousands of protesters been able to push the barricades against the police officers, in which they partly succeeded to, they would have caused grievous injuries to them considering how heavy the barricades are."

Justice Sharma held, " Prima facie, in the situation which is visible in the video clips including video clip number 3, the respondents in question are clearly visible being in the first line of the mob, pushing the barricades against the police officers and raising slogans.

"It is difficult to explain in words; the entire action being unfolded as it is clearly visible in the said video clip, the force used by Delhi Police is only of trying to hold on to the barricades against the violent mob which is also raising slogans of "Delhi Police Murdabad" and"Delhi Police Doob Maro" and are very violently pushing the barricades against the handful of policemen who were holding off the barricades," justice Sharma held.

The high court rejected the submissions that the accused persons were mere bystanders in the protest.

The court said that they were consciously part of the assembly which had turned violent and consciously did not leave the place of such violence and chose to remain part of it by insisting on going to a curfew-imposed area.

"They would have also known that while they were pushing the barricades against those few policemen, in case they would have succeeded, grievous injuries would have been caused to the police officers," the court added.

"They were, therefore, with the violent mob of protesters and it cannot be distinguished that they did not have the object collectively as that of the entire mob. Even otherwise to reiterate, the law of rioting envisages vicarious liability of each participant of an unlawful assembly, " Justice Sharma said.

Russian Man Charged Over Daughter's Anti-War Drawing Flees House Arrest

Russian Man Charged Over Daughter's Anti-War Drawing Flees House Arrest

A single father, who was separated from his daughter and sentenced on Tuesday to two years in prison over "discrediting" the Russian army, has fled house arrest, officials said.

Alexei Moskalyov, 54, first came to the authorities' attention last year after his daughter Maria drew a picture at school showing missiles next to a Russian flag heading towards a woman and child standing by a Ukrainian flag.

Subsequently a criminal case was opened against him over alleged comments criticising Russia's assault on Ukraine.

On Tuesday, a court in the town of Yefremov south of Moscow handed Moskalyov a two-year jail sentence over comments on social media criticising Moscow's assault on Ukraine.

But in a dramatic turn of events, court officials said Moskalyov had fled house arrest.

Moskalyov has been separated from his 13-year-old daughter as punishment for his criticism of Kremlin policies, a first in Russia, experts say.

"The verdict was read out in the absence of the defendant, because he disappeared and did not appear at the hearing," Elena Mikhailovskaya, a spokeswoman for the Yefremov district court, told AFP.

Moskalyov's lawyer Vladimir Biliyenko said he was in a "state of shock".

"His disappearance is a total surprise for me. This has happened for the first time in my career," he told AFP.

He said that Moskalyov's daughter Maria could be sent to an orphanage "within a month".

The Moskalyovs' case has garnered national attention and led to an online petition calling for the girl to be re-united with her father.

The pair hail from Yefremov, a small town of around 37,000 people some 300 kilometres (180 miles) south of Moscow.

School drawing

The case against Moskalyov was opened after Maria's headmistress contacted the police about her picture with the flags and the missiles.

Police said an online search uncovered comments criticising Moscow's action in Ukraine on the social media profiles of the girl's father.

In early March, authorities placed Maria in a "rehabilitation centre" for minors, while Moskalyov was put under house arrest.

On Monday, prosecutors demanded a two-year prison term for the father.

Since President Vladimir Putin sent troops to Ukraine over a year ago public criticism of Moscow's offensive in the pro-Western country has been outlawed.

During the height of Stalin-era purges in the late 1930s thousands of children were taken away from their parents.

In modern Russia, the first recorded attempts to strip activists of parental rights were in Moscow in 2019. Prosecutors' attempts to punish two families for taking their children to political protests were not successful at the time, however.

Even Yevgeny Prigozhin, head of the Wagner paramilitary force spearheading Russia's assault in eastern Ukraine, has voiced support for Maria and criticised the local authorities.

Rapper Jay Z's Net Worth Touches $2.5 Billion, Warren Buffett's Old Comments On Him Resurface

Rapper Jay Z's Net Worth Touches $2.5 Billion, Warren Buffett's Old Comments On Him Resurface

Billionaire Warren Buffett predicted that young people would soon turn to Jay-Z for financial guidance during an old interview with the rapper. Interestingly, the artist's net worth is now $2.5 billion, according to the latest Forbes estimates. Jay-Z was also the first billionaire rapper in the world. Since then, his fortune has increased as a result of a number of wise business decisions and ventures, creating what Forbes refers to as "a sprawling and diversified empire." According to its Real-Time Billionaires ranking, he is the 1,205th richest person in the world.

Amid this, an old Forbes interview of Jay-Z with the legendary investor is going viral. In the interview, he compared his approach to his music career with the Oracle of Omaha's strategy of investing only in businesses he knows rather than what is most popular.

"Music is like stocks. There's the hot thing of the moment. People tend to make emotional decisions based on that. They don't stick with what they know, you know, 'This is who I am. This is what I do.' They jump on this next hot thing. And it's not for you." Jay-Z told Forbes at the time.

At the conclusion of their conversation, Mr Buffett predicted that young people would soon turn to Jay-Z for financial guidance.

"Jay is teaching in a lot bigger classroom than I'll ever teach in. For a young person growing up he's the guy to learn from," the billionaire said.

With investments in Armand de Brignac champagne, D'Usse cognac, and different investment properties in New York and LA, Jay-Z became the first billionaire rapper back in 2019. His wealth has increased as a result of the expansion of his entertainment firm Roc Nation, the sale of the streaming service Tidal and numerous investments in businesses like Uber.

Yogesh, the victim, was freed after his father reached along with police at the office.

According to the complaint filed by Bhan Singh, a resident of Khatiwas village in Jhajjar district, his son Yogesh works at a finance company office in Sector 14.

Yogesh called his father on Monday morning and claimed that he was kidnapped and the suspects were demanding Rs 5 lakh.

A police team conducted a raid and rescued Yogesh from the pantry of the office. Later Yogesh filed a police complaint.

"In the same office Abhimanyu, Harish, Preetam and Narender also work with me. Harish had given me Rs 42,000 and I returned it to his account in the morning. Similarly, I also transferred Rs 40,000 to Abhimanyu's account on Sunday and Rs 29,000 on Monday. They, however, held me hostage in the office pantry and asked me to return the rest money.

"I asked them for some time but they clearly said I should bring the money to the office today itself otherwise I will not be allowed to go anywhere and then I called my father", Yogesh was quoted as saying in his complaint.

The police detained all four from the spot and took them to the police station.

Following the complaint, an FIR was registered against the four under sections 341 (wrongful restraint), 342 (wrongful confinement), 384 (extortion) of the IPC at sector 14 police station and police arrested all four accused on Monday night.

Russia To Place Submarines With Nuclear Torpedoes In The Pacific By 2024: Report

Russia To Place Submarines With Nuclear Torpedoes In The Pacific By 2024: Report

Russian is planning to complete the construction of its coastal infrastructure in early 2024. The country is planning to build it in the Pacific Ocean for basing nuclear submarines that will carry the Poseidon nuclear-capable super torpedoes, state-owned news agency TASS reported.

In January, Russia produced the first set of the Poseidon torpedoes, four years after President Vladimir Putin announced the fundamentally new type of strategic nuclear weapon, confirming it would have its own nuclear power supply, Reuters reported.

The report further shares a few confirmed details about the Poseidon in the public domain, but it is essentially a cross between a torpedo and a drone which can be launched from a nuclear submarine.

The torpedoes are being developed for deployment on the Belgorod and Khabarovsk nuclear submarines, TASS reported.

"Work on the construction of coastal infrastructure facilities for basing two special submarines in Kamchatka is planned to be completed early next year," TASS cited an unidentified defence source as saying.

Russia Pacific Fleet's ballistic nuclear missile submarine base is located on the southeastern coast of the Kamchatka Peninsula, in the Russian Far East.

The Pacific Ocean and the Sea of Okhotsk make up the Kamchatka Peninsula's eastern and western coastlines.

The source told the TASS state agency that a new division is being formed as part of the Submarine Forces of the Pacific Fleet, which will include not only Belgorod and Khabarovsk but also other submarines.

The new special-purpose submarines will participate in solving the tasks "of strategic deterrence", the source said.

Russia's major upgrade of the nuclear base comes amid rising U.S.-China tensions over influence in the Western Pacific.

Russia's President Vladimir Putin said on Sunday that Moscow is not creating a military alliance with Beijing, but both he and Chinese leader Xi Jinping pledged closer ties, including in the military sphere, during their meeting last week.

200 Barrels Of Oil Leaks Into Water At Southern England's Poole Harbour

200 Barrels Of Oil Leaks Into Water At Southern England's Poole Harbour

Anglo-French oil company Perenco's UK unit said on Sunday that a limited oil leak occurred at one of its well sites in Wytch Farm in Dorset, southern England.

Perenco UK said the spill was being contained and an investigation will be launched.

"Any spill is an extremely serious matter and a full investigation will be launched to ascertain what happened in Poole Harbour," Perenco UK's Wytch Farm General Manager Franck Dy said in a statement.

BBC reported that a major incident was declared after about 200 barrels of reservoir fluid leaked into the water at Poole Harbour.

Perenco UK produces about 40,000 barrels of oil equivalent a day, of which about 14,000 barrels is from Wytch Farm.

Poole Harbour Commissioners (PHC) has activated an oil spill plan and the pipeline had been shut down, with booms placed on either side of the leak, BBC said.

PHC did not immediately respond to a Reuters request for a comment.

Last year, the company's parent company declared force majeure for 150 days following a leak at its Cap Lopez oil terminal in Gabon.

2 Madhya Pradesh Discom Staffers Suspended Over Viral Video Showing This

Two staffers of a power distribution company were suspended after a video surfaced on social media of them forcibly removing the belongings of an elderly woman even as she ran after them in Madhya Pradesh's Sagar district, an official said on Sunday.

As per an official release, Sagar collector Dipak Arya has suspended two line attendants (Category II) of East Power Distribution Company stationed in Deori for demonstrating disrespectful and inappropriate behaviour and not following the rule book.

Apart from this, two other outsourced contractual workers with the Discom have been sacked, it said.

A video of the incident, which took place on Saturday shows the elderly woman, in a half-naked state, running after Discom staffers, who were forcibly removing her belongings from her shanty and loading it in a vehicle.

Slamming the BJP-led state government, the Madhya Pradesh Congress posted the video of the incident on its Twitter handle.

"Want To Kill Me": Gangster-Politician Atiq Ahmed On UP Police Custody

"Want To Kill Me": Gangster-Politician Atiq Ahmed On UP Police Custody

Soon after stepping out of the Sabarmati central jail here before being taken to Prayagraj by the Uttar Pradesh police, gangster-turned-politician Atiq Ahmed on Sunday alleged that the police personnel want to kill him under the pretext of court appearance in his home state.

"Hatya, hatya (murder, murder)," Atiq Ahmed told reporters outside the jail.

When some reporters asked him while he was being taken to a police van if he feared for his life, the former Samajwadi Party MP said, "Mujhe inka programme maloom hai...Hatya karna chahte hain (I know their programme...They want to murder me)." He also said that his appearance in a Prayagraj court was a just pretext for the police to kill him.

"Court ke kandhe pe rakh ke maarna chahte hain (They want to kill me under the pretext of court appearance)," he said as he was taken towards the van.

A team of the UP police reached the Sabarmati jail in Ahmedabad city in the morning and left the premises with Atiq Ahmed in a police van amid tight security around 6 pm after completing the necessary formalities.

The police convoy entered Rajasthan from Gujarat around 8.12 pm, an official said.

Atiq Ahmed will be produced before a court in Prayagraj city in Uttar Pradesh on March 28 when it is scheduled to pass an order in a kidnapping case in which he is an accused, officials said.

The Supreme Court had in April 2019 directed that the former MP from Phulpur in UP be shifted to a high-security jail in Gujarat after he was accused of orchestrating the kidnapping and assault of a real estate businessman Mohit Jaiswal while in jail.

He has been lodged in the Sabarmati central jail since June 2019. He was shifted there from his home state as per the Supreme Court's order.

He is named in more than 100 criminal cases, including the recent Umesh Pal murder case, police said.

Among the most sensational murders in which Atiq Ahmed is allegedly involved was that of Raju Pal, the MLA from the Bahujan Samaj Party (BSP) who was shot dead in 2005. Umesh Pal, a key witness in this murder case, was gunned down outside his residence in Prayagraj on February 24 this year.

Earlier this month, Atiq Ahmed moved the Supreme Court for protection, claiming that he and his family have been falsely implicated in the Umesh Pal murder case in Prayagraj and he may be killed in a fake encounter by the UP Police.

In his plea, Atiq Ahmed said the UP police were in all likelihood seeking his transit remand and police remand to take him from Ahmedabad to Prayagraj and he "genuinely apprehends that he may be eliminated during this transit period".

Whoever Tries To Disturb Peace In Punjab Won't Be Spared: Arvind Kejriwal

Whoever Tries To Disturb Peace In Punjab Won't Be Spared: Arvind Kejriwal

Delhi Chief Minister Arvind Kejriwal on Saturday said the Bhagwant Mann government in Punjab will not hesitate in taking tough decisions to maintain law and order as he asserted that those who were trying to spoil the atmosphere in the state are on the run.

Arvind Kejriwal's remarks come in the wake of Punjab police action against radical preacher Amritpal Singh and elements of an outfit, headed by him, named 'Waris Punjab De.' AAP supremo Arvind Kejriwal along with Punjab Chief Minister Bhagwant Mann was in Jalandhar, where the crackdown on the Khalistan sympathiser began on Saturday, to lay the foundation stone of Sri Guru Ravidas Bani Adhyan Centre at Dera Sachkhand Ballan here.

Addressing the gathering, Arvind Kejriwal said whoever tries to disturb peace in Punjab will not be spared.

"In the past few days, you saw how some people tried to disturb peace in Punjab," he said.

"We do not have to allow the atmosphere to be spoiled at any cost," he said, adding, "We have to maintain peace, law and order in Punjab." Arvind Kejriwal said the Mann government took tough decisions to maintain peace in the state.

"Sometimes, tough decisions have to be taken. But if our AAP government in Punjab under the leadership of Bhagwant Mann will have to take tough decisions then we will not hesitate from taking them," he added.

"Mann saab took tough decisions, but without a bullet being fired and blood being shed peace is maintained in the entire Punjab today," he said.

Amritpal Singh has been on the run after the police crackdown began. Several images and videos have showed him taking multiple vehicles to dodge police. The Punjab government has slapped the strictest National Security Act against him and some of his associates.

While the fugitive's whereabouts are still unknown, Punjab police say efforts are on to nab him.

Leh-Manali Highway Reopens For Traffic In A Record Time Of 138 Days

Leh-Manali Highway Reopens For Traffic In A Record Time Of 138 Days

The Border Roads Organisation (BRO) opened the Leh-Manali Highway (NH3) for traffic, in a record time of 138 days, on Saturday.

The 427-km strategic Leh-Manali Highway (NH3) connects Ladakh to the rest of India via Manali.

The highway is strategic as it facilitates the movement of the armed forces and their supplies and wares to forward areas in the Ladakh region, bordering both China and Pakistan, as well as connecting Ladakh to the rest of India.

The highway is an alternate axis to the Srinagar-Kargil-Leh Highway.

NH-1D, 422 km was opened by the BRO on March 16, 2023, and traffic has commenced on this axis. With the onset of winter and snow accumulation, the highway remains closed from November-end till it is opened to traffic by the BRO.

The entire snow clearance operations were executed by the BRO, under 'Project Himank' in Ladakh and 'Project Deepak' in Himachal Pradesh. The challenging snow-clearing operation commenced from two extremities and were carried out by two different teams, comprising skilled manpower and state-of-the-art machines.

'Project Deepak' was undertaken from Manali to Sarchu (Border of Ladakh and Himachal) and 'Project Himank' involved the clearing of the highway from Leh to Sarchu.

'Karmyogis' of both units worked in extremely challenging conditions, braving snow storms and high altitude areas, to clear the highway. They had to negotiate four important and high-altitude passes -- the Baralacha La (15910 ft), Nakee La (15547 ft), Lachung La (16616 ft) and Tanglang La (17482 ft).

A significant time of snow clearance was consumed in the clearance of these high mountain passes where the precipitation was more and the teams encountered snow walls of height 10-15 feet, stated a release on Saturday.

BRO, with a renewed focus on the early opening of all strategic roads and passes, has been progressively reducing the closure duration and opening the road earlier than the previous years.

In 2022 the road was opened for traffic move on March 26 and the BRO broke its own record in 2023 by reopening the road on Saturday.

As the two snow clearance teams converge to a common point, which is also the inter-project boundaries, a 'Golden Handshake' ceremony was organised at Sarchu on Saturday, in which the chief engineers of Project Himank, Brig Gaurav Karki, VSM and officiating chief engineer, 'Project Deepak', Col Vishal Guleria, cut the ribbon and declared the highway clear of snow and open.

Xiaomi Reports Record Drop in Q4 Revenue, Loses Indian Smartphone Market in Higher-End Devices to Samsung

Xiaomi Reports Record Drop in Q4 Revenue, Loses Indian Smartphone Market in Higher-End Devices to Samsung

Chinese smartphone maker Xiaomi on Friday reported a record drop in fourth-quarter revenue as the company weathered a slowdown in consumption and disruptions due to China's COVID-19 curbs.

Early signs suggest China's economy will only rebound slowly, as consumers remain cautious about spending money despite an easing of restrictions on domestic and international travel.

Xiaomi group president Lu Weibing, speaking on a company earnings call, said China's consumer electronics was seeing early signs of a recovery at present but "it will take time."

Year-on-year declines may continue in the first half of the year before a rebound occurs, he added.

Xiaomi's sales in the fourth quarter of 2022 reached CNY 66.05 billion (nearly Rs. 79,200 crore), down 22.8 percent from CNY 85.58 billion (nearly Rs.1,02,600 crore) a year earlier.

The numbers were slightly ahead of analyst expectations, but they mark the fourth consecutive revenue drop for the company, and its steepest on record yet.

Net income fell to CNY 1.46 billion (nearly Rs. 1,750 crore) over the period, down 67.3 percent from CNY 4.473 billion (nearly Rs.5,360 crore) a year earlier.

The company's revenue for 2022 was CNY 280.04 billion (nearly Rs. 3,35,800 crore), a drop of 14.7 percent, while net income came in at CNY 8.52 billion (nearly Rs. 10,200 crore), down 61.4 percent. Both figures fell short of analyst expectations.

Smartphone slump

Overall consumption in China dragged on most product categories in the fourth quarter, as the abrupt lifting of strict COVID-19 curbs led to a rapid spread in infections across the country.

All major smartphone brands experienced a sales slump in China over the period, based on research firm Canalys. Xiaomi, however, took the largest hit with shipments dropping 37 percent year on year, the Canalys data showed.

China's smartphone sales endured a record fall in 2022, down 14 percent to 287 million units, Canalys data shows. That marked the first time in ten years shipments fell below 300 million units.

Xiaomi is also facing headwinds in India, where it failed to notice a rising consumer preference for higher-end devices and ended up losing its position as the top-selling phone brand to South Korea's Samsung in the fourth quarter.

The company, along with its rivals, could also face new security probes from Indian authorities due to national security concerns over pre-installed apps.

India is Xiaomi's largest overseas market and world's second biggest market for smartphones.

Xiaomi is also expanding into electric vehicles. The company said on Friday that it is "on track" to reach its goal of mass producing its first cars in the first half of 2024.

Terraform Founder Do Kwon Charged for Forging Documents by Montenegrin Police

Terraform Founder Do Kwon Charged for Forging Documents by Montenegrin Police

Montenegrin police on Friday formally charged Do Kwon, the cryptocurrency entrepreneur behind two digital currencies that lost an estimated $40 billion (nearly Rs. 3,29,500 crore) or more last year, for forging official documents after arresting him on Podgorica airport.

Do Kwon, a South Korean national, and a second suspect have been held on Thursday while trying to board a flight to Dubai at Podgorica airport.

Police said in a statement they had found forged Costa Rican passports and a separate set of Belgian passports in their luggage during the encounter.

The two suspects have also been charged before a Podgorica court with forging of official documents, it said.

"Pending completion of the (court) proceedings they will be taken to an investigative judge...for further actions according to an international (arrest) warrant," it said.

It also said that an international warrant had been issued against the two "to ensure their presence... before the Southern District Court in Seoul on suspicion of committing several criminal acts in the field of economy."

Several hours after Kwon was detained in Podgorica, the US District Court in Manhattan made public an eight-count indictment against him.

Lawyers for Kwon in the United States did not immediately respond to requests for comment after business hours.

Thursday's indictment charges Kwon, who co-founded Terraform Labs and developed the TerraUSD and Luna currencies, with two counts each of securities fraud, wire fraud, commodities fraud and conspiracy.

Both currencies crashed last May, with TerraUSD's price sinking to less than one penny.

The criminal case follows related US Securities and Exchange Commission civil charges against Kwon and Terraform last month.

Kwon had been a fugitive for several months. South Korean authorities issued an arrest warrant for him last September.

South Korean police said on Friday the identity of the suspect arrested in Montenegro had been confirmed as Kwon after his fingerprints matched the information held by the country's National Police Agency (KNPA).

Rahul Gandhi Can Ask For MP Status Revival If Jail Term Stayed: Experts

Rahul Gandhi Can Ask For MP Status Revival If Jail Term Stayed: Experts

Congress leader Rahul Gandhi, who was disqualified as a member of the Lok Sabha on Friday, is entitled to go back to the Speaker for revival of his MP status if he gets a judicial order from an appellate court staying his two-year jail sentence and conviction in a 2019 criminal defamation case, according to legal experts.

Mr Gandhi, a former Congress president, was on Thursday sentenced to two years in jail by a Surat court after he was held guilty of defamation over his "Modi surname” remark. The court also suspended the jail sentence for 30 days to allow Gandhi to appeal in a higher court.

Senior advocate and Supreme Court Bar Association(SCBA) President Vikas Singh said Gandhi will have to move quickly to a superior court and get suspension of the sentence and the stay of conviction to get his Lok Sabha membership revived before the Election Commission comes into the picture and announces a by-election from his parliamentary constituency in Wayanad in Kerala.

“If there is a stay of the conviction then his membership can be revived. He will have to move the appellate court immediately. He needs a stay of the conviction then there will be no election on his seat,” Mr Singh said.

Another senior advocate Ajit Sinha echoed the same view, saying the appellate court can stay the conviction and the after effect should be the restoration of his membership of the Lok Sabha.

Senior lawyer and constitutional law expert Rakesh Dwivedi said he was of the view that the disqualification was illegal as Gandhi was granted 30 days time and in any case now he should seek a stay quickly if he needs relief.

“When he gets a stay from a higher court, the disqualification would stand in abeyance....In my view since the sentence has been kept suspended for a month, the disqualification is illegal,” Mr Dwivedi said.

Giving details as to what lies ahead for Mr Gandhi so far as legal remedies are concerned, senior advocate Siddharth Luthra noted that the trial is now over, the conviction and the sentencing has happened and as a result the disqualification has taken effect.

Now the matter will be taken up by the sessions court, the first court of appeal in this case if there is a challenge, Mr Luthra said, adding “I presume there will be a prayer before the sessions court not only to suspend the sentence but also to stay the conviction." "In the event of a stay of conviction, Mr Gandhi then will be entitled to go back to the Speaker and say that now, my conviction has been stayed so the disqualification cannot remain in effect.” In any case, if there is a stay of conviction, Gandhi can take part in the 2024 Lok Sabha elections, Mr Luthra added.

According to Vikas Singh, the disqualification of Rahul Gandhi was wrong.

“The law is meant to save up to two years ...there is a Supreme Court judgement in an income tax case where the Supreme Court interpreted the term ‘up to' and said ‘upto' means the term beyond.. here the sentence prescribed is ‘up to two years or more' .. this is meant to save the persons awarded two years jail term as sentence from disqualification,” he said.

Even the CrPC (Code of Criminal Procedure) does not treat the offences entailing a two-year jail term as serious and the legislative intent was to save up to two years, he said.
